Background and description of the application
The Regystrum software application (also called, hereinafter, “Application”) was entirely designed and manufactured by Comtaste S.r.l. (registered office: Rome, Italy, Via Nomentana 761 – VAT and Tax Code 08673311000) and is accessible via the Internet in SaaS mode (“Software as a Service”). Regystrum aims to manage activities related to the registration, archiving and distribution / assignment of documents in electronic format and files of all kinds within an organization.
Regystrum is highly integrated into the “G Suite” platform, of which it also uses the login authentication procedure (single-sign-on). Therefore, in order to be able to use the application, the Customer must have his own G Suite accounts.
All Intellectual Property Rights on the Application and all its components and characteristics are and remain by Comtaste, understood in the broadest sense, such as software, brands, trade and industrial secrets, graphics and the “look & feel” ”, the structure, the organization, the design, the algorithms, the data models, the operational flow, the texts, the logos.
The Customer undertakes not to attempt reverse engineering activities, not to copy, modify, decompile or disassemble the software, or in any way attempt to reconstruct or discover the source code of the application. In any case, Comtaste reserves every right relating to the application that is not expressly attributed to the Customer within these general conditions.
Comtaste will have a free, unlimited, universal, transferable and perpetual license to use or incorporate in the application any and all suggestions, ideas, requests for improvement or new features or characteristics and any other information provided by the Customer relating to the application.
Regystrum is aimed at companies and freelancers, as well as organizations and entities of any kind, including public entities, for the purposes of normal use within its organizational structure. These recipients are referred to below with the generic term “customers”.
The resale and / or any form of transfer to third parties is forbidden to the Customer, even free of charge.
At the time of the purchase order, each customer must provide their name and / or company name, tax information, full postal address, telephone and e-mail address. The Customer undertakes to provide only true and correct contact and billing information. The Customer undertakes to use the application in accordance with the provisions described in this document, the provisions of the law and any other current regulatory provision and, in any case, not to implement or encourage any use of the application that may be illegitimate or harmful to others’ rights, interests and powers. In any case where the Customer’s conduct no longer complies with the terms of these conditions, or in cases in which anomalous use of the application is found, Comtaste S.r.l. reserves the right to take any measure it deems necessary, including that of immediately prohibiting access to the account by the Customer or otherwise suspending its activity. Comtaste has the right to mention the Customer, also on its website or other means of mass communication, as a user of Regystrum. It is the Customer’s right, moreover, to request by email to firstname.lastname@example.org that his name or company name be removed from the publication.
Regystrum is an application that does not require particular skills or learning activities from users and is based on the same intuitive methods of use that characterize Google Apps. In any case, following the subscription of the service, the Application’s User Manual is provided to the Customer. It is recommended that the user viewing at least the paragraphs “Installation and first access” and “Settings and customizations” contained in the manual.
The subscription to the service does not include any support activities and guidance on the use of the application. Any requests for the supply of dedicated support or help desk services may be subject to a separate financial offer by Comtaste. In any case, following the subscription of the service, the Application’s User Manual is provided to the Customer. It is recommended that the user viewing at least the paragraphs “Installation and first access” and “Settings and customizations” contained in the manual.
The subscription to the service does not include any support activities and guidance on the use of the application. Any requests for the supply of dedicated support or help desk services may be subject to a separate financial offer by Comtaste. In any case, any reports from the Customer regarding the detection of bugs in the application can be sent by email to email@example.com. On these reports, the Regystrum support team will activate with the “best effort” criterion.
Variation of these conditions
Comtaste reserves the right to change the terms and conditions of use at its discretion, notifying the user of these changes by means of a notice published on its website and / or by sending an e-mail. The Customer is obliged to accept the aforementioned changes without prejudice to the right to withdraw from the contract.
Application architecture and referral legislation
Regystrum is installed on Google App Engine, the Google hosting and application development platform that is part of the Google Cloud Platform, to whose specific rules and conditions of service please refer https://cloud.google.com/docs terms /). The application also stores the archived files directly on the Drive of a G Suite user designated by the Customer. Even outside of the use of Regystrum, on Google Drive all documentation registered with Regystrum can be viewed and downloaded by the Customer. The use of the Drive space beyond a certain limit (established by Google) has a cost that will have to be borne by the Customer in case of need for additional storage space. The additional space can be purchased directly by the Customer, to whom Google automatically notifies the approaching saturation of the available space. All the conditions of service provided by the G Suite platform apply, to which specific reference is made, and which the Customer has already accepted as a G Suite user. The reference regulations guarantee, among other things, certain levels of uptime, security, privacy and quality of service. In any case, Comtaste guarantees that access to the application code, for maintenance and updating activities, is carried out exclusively by people who are trusted and under their control. In addition to what is described above regarding the possibility of the Customer to access and download the logged files, in order to strengthen the Customer’s potential to free himself in the future, if he wishes, from the use of Regystrum, a procedure of download of the data associated with the protocols carried out, such as for example the protocol number, the date, the title, the classification, the history and the description of each individual protocol carried out in the time interval desired by the Customer.
The use of Regystrum is allowed against payment of a fee for a term use license, as agreed with each Customer, or free of charge for their own promotional purposes. These Conditions also apply to any free use licenses and trial licenses.
Commercial invoices for the fees paid are issued and sent to the Customer in electronic format and via email.
Any problems dependent on the G Suite and Google App Engine platforms such as, for example, transient errors, downtime and unreachability of the service, data loss, etc. are not attributable to the application, nor therefore to Comtaste. The specific regulations to which reference has already been made indicate in such cases the form and extent of the compensation due to the Customer by Google. In any case, any compensation due to the Customer by Comtaste cannot exceed the equivalent of 2 (two) months of consideration paid by the Customer for the use of Regystrum.
Applicable law and jurisdiction
The provision of the service will be governed exclusively by Italian law. For any controversy regarding the interpretation or execution of these conditions, the Court of Rome will have exclusive jurisdiction.
The collection and processing by Regystrum of the data provided by the user takes place in compliance with Legislative Decree no. June 30, 2003, n. 196 and any other legislation regarding the protection of privacy. The information collected is not shared with other companies and the data of our customers are used exclusively to carry out contractual obligations, administrative and contact practices. The data controller is Comtaste S.r.l., via Nomentana 761, Rome, in the person of its pro tempore Director.
